1. Introduction, User’s Acknowledgment, and Acceptance of Terms
Heron Dance Press Inc. (“Heron Dance Press”,“We”) provides this Site as a service to readers and Subscribers or anyone who accesses the Site (“You,” “Your,” “User,” “Users”). Your use of the Site or any Heron Dance Press product or service is expressly conditioned upon your acceptance of these Terms of Use including our Privacy Policy (“Terms”).
YOU AGREE TO BE BOUND BY THESE TERMS BY REGISTERING ON, VIEWING OR USING THIS SITE. IF THESE TERMS ARE NOT ACCEPTABLE TO YOU, PLEASE LEAVE THE SITE IMMEDIATELY. IF FOR ANY REASON YOU ARE DISSATISFIED WITH THE SITE, OR ANY SERVICE, PRODUCT, CONTENT, OR OTHER INFORMATION AVAILABLE ON OR THROUGH THE SITE, YOUR SOLE REMEDY IS TO CEASE USING THE SITE AND/OR PARTICULAR SERVICE OR PRODUCT. We may modify, add or delete portions of this Terms of Use or Privacy Policy from time to time in our sole discretion. We will post the updated version on the Site. Your use of the Site or continued receipt of Information constitutes acceptance of such modifications, which shall be effective immediately upon posting on the Site.
2. The Content On This Site, And In Heron Dance Press Published Materials Is Copyrighted
You may not reproduce, distribute, transmit, disseminate, sell, publish, display, broadcast, circulate or forward any part of Heron Dance Press or this web site to anyone, including but not limited to others in the same company or organization, without the express prior written consent of Heron Dance Press Inc. This requirement and limitation includes, for example, electronic activities (such as emailing, scanning, web site posting, downloading, printing, ftp, etc.), photocopying, printing, faxing and the like. Authorized subscribers may print a single copy, not multiple copies, of Heron Dance Press from this web site solely for your own personal use. Additionally, authorized subscribers occasionally may use the Grant’s website “Share an Article” function to provide an Heron Dance Press article to a non-subscriber who may find it of interest. Subscribers may not share articles on a regular basis that could provide the recipient the benefits of a subscription. Using the share function results in I-(G)-I receiving contact information for persons who might be interested in subscribing and information on which articles subscribers believe to be of wider interest.
NO OTHER COPYING, OF ANY KIND IS AUTHORIZED.

3. Risks of Information and Use of the Site
Heron Dance Press does not verify or monitor the accuracy, truthfulness, or completeness of any Information provided on the Site by such Information Providers and sent to you in the Information. Said Information may contain opinions, forecasts, or projections of the Information Providers and thus may not be fact. You should consider the motives of any Information Provider and independently verify any Information or claims they provide. Heron Dance Press does not endorse any opinion or recommendation by any Information Provider. We do not verify the identity of our Information Providers and thus you should not rely that the identity of any Information Provider is who they say they are.

Heron Dance Press does not claim any ownership rights in any such User Content and nothing in these Terms of Use will be deemed to restrict any rights that you may have to use and exploit any such User Content.
You acknowledge and agree that you are solely responsible for all User Content that you make available through the Site. You agree that Heron Dance Press is not responsible for any legal action, harm, or loss resulting from providing User Content to our Users. You represent and warrant that: (i) you either are the sole and exclusive owner of all User Content that you make available through the Site or you have all rights, licenses, consents and releases that are necessary to grant to Heron Dance Press the rights in such User Content, as contemplated under these Terms of Use; and (ii) neither the User Content nor your posting, uploading, publication, submission or transmittal of the User’s Content or Heron Dance Press’s use of the User Content (or any portion thereof) on, through or by means of the Site will infringe, misappropriate or violate a third party’s patent, copyright, trademark, trade secret, moral rights or other intellectual property rights, or rights of publicity or privacy, or result in the violation of any applicable law or regulation.
You agree not to post, upload, publish, submit or transmit any text, graphics, information or other material that: (i) infringes, misappropriates or violates a third party’s patent, copyright, trademark, trade secret, moral rights or other intellectual property rights, or rights of publicity or privacy; (ii) violates, or encourages any conduct that would violate, any applicable law or regulation or would give rise to civil liability; (iii) is fraudulent, false, misleading or deceptive; (iv) is defamatory, obscene, pornographic, vulgar or offensive; (v) promotes discrimination, bigotry, racism, hatred, harassment or harm against any individual or group; (vi) is violent or threatening or promotes violence or actions that are threatening to any other person; or (vii) promotes illegal or harmful activities or substances.
You agree not to provide any User Content that contains material, non-public information or knowingly post statements that are not true.
6. Credentials and Security
You agree that your account with us is for your sole use and agree not to share or otherwise make your account available to others. Furthermore, you agree to keep your credentials including your password secure. You agree that you are liable for any use of the site done with your credentials.
Users of the Site agree that they will maintain only one account on the Site.
7. User’s Conduct on the Site
In addition to these Terms, Members and Subscribers of the Site agree to follow such rules that are posted on the site and amended from time to time. Such rules are posted within the forums and are incorporated by reference.
Heron Dance Press reserves the right, but has no obligation, to delete any content that violates the Terms of this agreement or is otherwise objectionable to Heron Dance Press. We are not responsible for any delay in deleting such content if we chose to delete such content.
Heron Dance Press reserves the right, but has no obligation, to terminate the membership, subscription, use, or specific feature of the site of any User who violates the law or these Terms. If your membership, subscription, or use is terminated, your obligations under these Terms, including, but not limited to indemnification and unpaid fees shall survive such termination.
8. Payment and Refunds
Payment for subscriptions is done in advance and by default renews automatically for periods subsequent to your initial purchase. If you do not pay your subscription when due we will terminate your service. You agree that your credit card or other payment service will be charged automatically for renewal unless you notify Heron Dance Press in advance that you wish to disable automatic renewal. Unless you are otherwise notified, the duration of such renewal will be the same as the length of the initial subscription (e.g. yearly subscriptions renew in yearly increments). Renewals will be at the then current rate applicable for your subscription duration. If your credit card company refuses to pay the billed amount for any reason, you agree that we may terminate your service.
HERON DANCE PRESS PROVIDES A PRORATA REFUND, ON REQUEST, OF ALL MONEYS PAID FOR A SUBSCRIPTION ON CANCELLATION.
9. Disclaimer of Warranty, Limitation of Liability, and Indemnification
THE INFORMATION AND MATERIALS ON THIS SITE ARE PROVIDED ON AN “AS IS”, “AS AVAILABLE” BASIS. HERON DANCE PRESS DOES NOT GUARANTY THAT THE INFORMATION OR ANY INFORMATION ON THE SITE IS ACCURATE OR CURRENT. HERON DANCE PRESS MAKES NO WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, WITH RESPECT TO THE INFORMATION OR THE SITE. ALL IMPLIED AND STATUTORY WARRANTIES, INCLUDING BUT NOT LIMITED TO, THE WARRANTY OF MERCHANTABILITY, THE WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE, AND THE WARRANTY OF NON-INFRINGEMENT OF PROPRIETARY RIGHTS, ARE EXPRESSLY DISCLAIMED TO THE FULLEST EXTENT PERMITTED BY LAW. HERON DANCE PRESS RESERVES THE RIGHT TO CHANGE THE CONTENT OF THE SITE AT ANY TIME WITHOUT NOTICE.
TO THE FULLEST EXTENT PERMITTED BY LAW, HERON DANCE PRESS EXPRESSLY DISCLAIMS ALL LIABILITY FOR, AND YOU AGREE TO INDEMNIFY AND HOLD HERON DANCE PRESS, ITS MEMBERS, OFFICERS, AND AFFILIATES HARMLESS FOR, ANY DAMAGES OR LOSSES AS A RESULT OF YOUR USE OF OR INABILITY TO USE THE SITE, THE INFORMATION OR MATERIALS YOU PROVIDE TO THE SITE, THE INFORMATION OR YOUR RELIANCE ON THE INFORMATION CONTAINED ON THE SITE, OR YOUR VIOLATION OF THESE TERMS OR APPLICABLE LAW.
10. General
You have the sole responsibility to purchase and maintain the equipment and communications services you use to access this Site. We are not responsible for any costs or damages caused to your equipment and communications services that happens because of access to the Site.
You agree that your account is non-transferable and that any rights to your account terminate upon your death.
These Terms as specified in this document constitute the entire agreement between you and Heron Dance Press.
Any legal dispute arising out of your use of the Site or these Terms will be governed by the laws of the United States of America and the Commonwealth of Pennsylvania without giving effect to rules governing choice of laws. Those who choose to access the Site from locations outside of the United States do so on their own initiative, and are responsible for compliance with local laws if and to the extent local laws are applicable. The Information provided by Heron Dance Press is not intended for distribution to, or use by, any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation or which would subject Heron Dance Press to any registration requirement within such jurisdiction or country.
Regardless of any applicable statue or law, you agree that any claim or cause of action related to the use of the Site, our Terms of Use, or Privacy Policy must be filed within one (1) year after such claim or cause of action arose or it shall forever be bared.
If any part of these Terms is found unenforceable or invalid, that part shall be construed as closely as possible in a manner consistent with applicable law to reflect the original intentions and the remaining parts shall remain in full force and effect.
